I try to ensure that my portraits delight, and that this site operates smoothly and fairly. I'll be legal, decent and honest in my dealings with you. And below are terms and conditions for the use of this website, and of you're buying from me, my trading terms.

Website Terms (if you're browsing this site)

  1. All the information on my website has been included in good faith and for general information purposes only. It should not be relied on for any specific purpose and no representation or warranty is given as regards its accuracy or completeness.
  2. Neither I nor any of my employees shall be liable for any loss, damage or expense arising out of any access to or use of this site or any site linked to it including, without limitation, any loss of profit, indirect, incidental or consequential loss.
  3. I reserve the right to make any changes and corrections to this site as and when I consider it appropriate and without notice.
  4. I have placed links to external sites which I think you may find interesting but neither I nor my employees or agents shall have any responsibility or liability of any nature whatsoever for these other sites or any information contained in them, none of which have been verified or endorsed by the me. Nor does a link apply an association with the site.
  5. This website is provided 'as is', without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Trading Terms (if you're buying a portrait)

  1. I create and sell very high definition digital portraits, created in my own styles, and you understand that is what you're buying.
  2. I work from a mutually agreed brief with you which specifies the Artwork. I'll email it to you, and you must agree it before creative work starts.
  3. You agree to pay a deposit before my work starts - usually 20% but this may be higher if you require third party photography rights for an Imaginary Portrait)
  4. I will sketch and photograph you for reference purposes at a sitting in a location of your choice, and you agree to make time for that.
  5. I will paint the portrait in my studio. You're welcome to watch, it takes a week or more.
  6. I use physical paints, pencils, inks and other art materials, computers and professional digital tools. The choice of which materials is mine.
  7. I will email you pre-approval images of the artwork which are low-resolution and watermarked.
  8. If you require adjustments of any sort just ask for them (within the limits of the portrait service you're buying).
  9. You're entitled to reject the revised Artwork if you're not happy with it and I will give you a full refund of my artist's fees (this excludes travel, materials and third party photo rights).
  10. I supply Giclee, litho and photographic prints of your artwork, plus the master file.
  11. I reserve the right to reproduce a copy of the Artwork for my own uses.
  12. All preliminary sketchs, drafts and artwork belongs to me alone. You may not display, copy, transmit or otherwise use them for any purpose.
  13. The final artwork you can hang anywhere, and lend or show to anyone.
  14. You can use the electronic master file for any non-commercial purpose (eg publishing on Facebook or Google profiles), but you may not not sell the file nor use it to contribute to commercial publications, blogs, galleries, nor use it for any other commercial purpose.
  15. I will deliver the Artwork to you with the mounting and framing options you choose, after approval and payment.
  16. I will also email the master file to you un-watermarked, high resolution format, again after approval and payment.
  17. Full payment by you of all artists fees, expenses and any additional costs is required before you own any artwork.
  18. All invoices are payable with 30 days. I charge 1.5% on all overdue balances per month.
  19. I provide a Certificate of Authenticity with your Artwork, which confirms that it is genuine.
  20. You are responsible for any applicable taxes levied by governments where you live. These include sales taxes and import taxes.
  21. Third parties mount or frame the artwork and sometimes print it too. Their costs are not included in my artist's fees. I will discuss these with you early on, so they're not a surprise. These costs are controlled by you, not me.
  22. Your lighting conditions will determine how long the Artwork lasts. I provide no guarantee, however the manufacturers of the materials I use generally suggest between one and two centuries.
  23. I'm not responsible for any damages consequential or otherwise, as a result of you commissioning or receiving the artwork.
  24. I reserve the right to change the terms under which any artwork is provided at any time.
  25. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
